Rosen v. BMO Nesbitt Burns Inc., 2013 ONSC 2144

  • Eli Karp acted for a former employee of BMO Nesbitt Burns who brought a class action against BMO Nesbitt Burns for unpaid overtime hours. The class action was certified by Justice Belobaba. Leave to appeal was denied by the Divisional Court. 

Wellman and Corless v. TELUS and Bell, 2014 ONSC 3318

  • Eli Karp acted for a customer of TELUS and a customer of Bell who each brought a class action against TELUS and Bell, respectively, for alleged overcharging through the defendants' practice of rounding up airtime to the farthest minute. These actions were certified as class proceedings. Leave to appeal was denied by the Divisional Court.

Corless v. KPMG LLP​, 2008 CanLII 39784 (ON SC)

  • Eli Karp acted for a former employee of KPMG LLP, a prominent accounting firm, who brought a class action against KPMG LLP for unpaid overtime hours. The Superior Court of Ontario certified the class action and KPMG LLP ultimately settled with the employees and former employees for 100% of the amounts owed for overtime hours worked.

Wein v. Rogers Cable Communications Inc., 2011 ONSC 7290

  • ​Eli Karp acted for a customer of Rogers Cable Communications Inc. who brought a class action for misrepresentations made by Rogers with regard to the pricing of minutes. The class action was certified by Justice Horkins and a settlement was approved.
